1. Agreement to Terms

By creating an account or using TradeQuote ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. TradeQuote is operated by an individual sole trader based in the United States. Contact: mohamed61924@outlook.com.

2. Description of Service

TradeQuote is a web-based application that allows tradespeople to create quotes and invoices, manage customer records, and generate quote content using AI. The Service is provided on a subscription basis with a free trial period.

3. Accounts

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • One person may not maintain more than one free trial account.
  • You must provide accurate information when creating your account.

4. Free Trial

New accounts receive a 14-day free trial with access to all features, subject to plan limits. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial offer at any time.

5. Subscriptions and Billing

  • Paid subscriptions are billed monthly in advance. Your subscription renews automatically on the same date each month unless cancelled.
  • All prices are in USD. We reserve the right to change pricing with 30 days' notice to existing subscribers.
  • Payment is processed by Stripe. By subscribing, you agree to Stripe's terms of service.
  • Cancellation: You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
  • Refunds: We do not offer refunds except where required by law. If you believe you were charged in error, contact us within 14 days.
  • AI quote generation limits reset on your monthly billing anniversary, not on the 1st of each calendar month.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Use automated scripts to access the Service in a way that could damage or overload it.
  • Resell, sublicense, or otherwise commercialize access to the Service without our written consent.
  • Enter false, misleading, or fraudulent information into quotes or invoices.
  • Use the AI quote generation feature to produce content unrelated to legitimate trade work.

7. AI-Generated Content

The AI quote generation feature produces suggested content based on your input. You are solely responsible for reviewing, editing, and verifying any AI-generated quote before sending it to a customer. TradeQuote makes no guarantees about the accuracy, completeness, or suitability of AI-generated content. Prices, quantities, and scope of work should always be verified by you before use.

8. Your Data

You own the data you enter into TradeQuote — your customer records, quotes, and invoices. We do not claim any ownership over your content. You grant us a limited license to store and process your data solely to provide the Service. See our Privacy Policy for full details.

9. Availability and Modifications

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. For material changes that affect paid subscribers, we will provide reasonable advance notice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEQUOTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that we believe harms the Service or other users. Upon termination, your access to the Service ends immediately. You may request an export of your data before termination. Provisions relating to liability, disclaimers, and governing law survive termination.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the app at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
